In continuation of my Confidential Despatch

of the 36th August, I have the honour to transmit the enclosed

copy of proceedings before the Executive Council against the Captain Superintendent of Police on the charges arising out of the disposition of the Police at Cheung Chau which the raid on that Station disclosed.

The Executive Council advised that ir. F. J. Badeley had not exculpated himself from the charges made against him, and that he was guilty of an error of judgment in thinking that the Station was not open to attack; a majority advised that he was guilty of blameworthy conduct in permitting without the express sanction of the Government the disposition of Police at the Station which obtained prior to the attack. A minority com- -posed of the Colonial Secretary and myself recorded the opinion

that he was guilty of neglect of duty in permitting such dis-

-position.

In his defence Mr. Badeley seeks to shift the

responsibility for the disposition of the rolice on to the

Government. The matshed which the Sergeant occupied was erected by

a former Sergeant at his own expense. No record can be found of

the Covernment having been consulted in the matter, and seeing

that the matter was a private transaction the inherent probability

is that Government was not consulted. The contention that Govern-
